Terms of Service

Effective date: June 10, 2026

These Terms govern your use of the Lensly mobile app, the Lensly App Clip, and our website at lensly.camera (together, the “Service”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

01Who may use the Service

  • You must be at least 13 years old to use the Service.
  • If you are under the age of majority in your region, you may only use the Service with the consent of a parent or guardian.
  • You may use the Service on behalf of an organization only if you have authority to bind that organization to these Terms.

02Your account

  • Some features require an account, which you can create with your email, Apple, or Google.
  • You are responsible for keeping your credentials secure and for activity that happens under your account.
  • Tell us right away at hello@lensly.camera if you suspect unauthorized access to your account.

03Purchases and refunds

  • You can purchase increased participant capacity and other add-ons; pricing is shown in the app before you buy.
  • Payments on iOS and Android are processed by Apple or Google respectively, subject to their terms.
  • All purchases are final, except where a refund is required by law or where a technical issue within our control prevented the purchase from working.
  • To request a refund, email hello@lensly.camera within 14 days with your transaction ID and a short description of the issue.
  • For events with more than 200 participants, custom pricing is available — reach out and we'll help.

04Permissions and device access

  • Camera access is used only while you take photos, and photo library access only while you select photos.
  • Push notifications are optional and can be managed in your device or app settings.
  • You are responsible for any mobile data or carrier charges that result from using the Service.

05Your content and films

Ownership

You keep ownership of the photos you upload.

License to Lensly

You grant Lensly a worldwide, royalty-free license to host, process, transmit, display, and back up your photos and film data, solely so we can operate and provide the Service.

Film hosts

  • Hosts control access through invite links or codes, and set visibility, participant limits, and reveal time.
  • Participants grant the host a non-exclusive license to use uploaded photos only for running, viewing, sharing, and exporting that film for personal, event, or internal purposes.
  • Any commercial use of a participant's photo requires that uploader's permission.

Participants

  • You keep ownership of your photos.
  • You grant the film host the limited license described above.
  • Your photos may be visible to other participants depending on the film's settings.

General

  • You must have the rights to any content you upload and share.
  • We may remove content or suspend accounts that violate these Terms.
  • Lensly is not a backup service — please keep your own copies of anything important.

06Acceptable use

You agree not to:

  • Break the law; violate others' rights; or upload content that is unlawful, infringing, harassing, hateful, pornographic, or excessively violent.
  • Upload other people's photos without permission.
  • Reverse engineer, interfere with, disrupt, or overload the Service.
  • Use bots, scrapers, or any unauthorized automation.
  • Impersonate anyone or misrepresent your affiliation.

07Intellectual property and feedback

The Service, including its software, design, and branding, is owned by Lensly and protected by intellectual-property laws. If you send us feedback or suggestions, we may use them without any obligation to you.

We rely on third-party providers to run the Service, including:

  • Firebase (a Google service) — database, authentication, and storage.
  • Vercel — website and API hosting.

These services are governed by their own terms. We are not responsible for third-party websites or materials linked from the Service.

08App Store terms

Apple

  • These Terms are between you and Lensly, not Apple. Apple is not responsible for the app or for providing support.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Apple's Licensed Application End User License Agreement also applies on iOS and controls in the event of any conflict.

Google

  • These Terms are between you and Lensly, not Google. Your use of the Android app must follow Google Play's policies.
  • Google is a third-party beneficiary of these Terms and may enforce them.

09Copyright (DMCA) notices

If you believe content on the Service infringes your copyright, send a notice to hello@lensly.camera that includes:

  • Your contact information.
  • Identification of the copyrighted work.
  • The specific URL or location of the material.
  • A good-faith statement that the use is not authorized.
  • A statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act.
  • Your physical or electronic signature.

We may terminate the accounts of repeat infringers.

10Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow these disclaimers, so you may have rights that cannot be waived.

11Limitation of liability

To the fullest extent permitted by law, Lensly will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. Our total liability for any claim is limited to the amount you paid us in the six months before the claim arose. These limits apply even if a remedy fails its essential purpose.

12Indemnity

You agree to defend and hold Lensly harmless from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or the law.

13Termination

  • You may stop using the Service at any time.
  • We may suspend or terminate access, or remove content, for alleged violations of these Terms.
  • Sections that by their nature should survive termination will remain in effect.

14Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify you in-app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.

15Governing law and disputes

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The Federal Arbitration Act governs the arbitration agreement below.

Informal resolution

Before filing a claim, please email hello@lensly.camerawith “Dispute” in the subject line so we can try to resolve it. If we cannot resolve it within 30 days, either party may proceed.

Arbitration

Disputes will be resolved by binding individual arbitration administered by JAMS before a single arbitrator. Hearings may be held by video or phone, or in person (U.S. consumers may choose their county of residence).

Exceptions

  • Small-claims matters may proceed in small-claims court (your county or New Castle County, Delaware).
  • Claims seeking only public injunctive relief may proceed in court.
  • Intellectual-property disputes may proceed in court.

Class waiver

Claims may be brought only on an individual basis — no class actions or class arbitrations — and the arbitrator may not consolidate claims.

30-day opt-out

You may opt out of this arbitration section within 30 days of first accepting these Terms by emailing hello@lensly.camera with your name, account email, and a clear opt-out request. If you opt out, neither party is bound by this section for future disputes.

16Other terms

  • Export: you must comply with U.S. export laws; the Service may not be used in embargoed countries or by prohibited parties.
  • Severability: if a term is unenforceable, the rest remains in effect.
  • Assignment: we may assign these Terms; you may not without our consent.
  • No waiver: not enforcing a term is not a waiver of it.
  • Language: the English version of these Terms controls.
